    Why File a Lawsuit?

    If you served a Notice of Claim and have still not been paid, then filing a Lawsuit is the next mandatory step to enforcing your Claim.  In fact, if you do not file a Lawsuit within the required statutory deadline, then you will waive your right to enforce a Claim against the Payment Bond.  Alternatively, if you have missed the deadline to serve a Notice of Claim, then filing a Lawsuit is your first step (other than sending a formal Payment Demand Letter) to enforcing your Claim. 

    Depending upon your particular circumstance, your Lawsuit could include Claims for: breach of contract; breach of the Payment Bond; fraudulent inducement to enter into a contract (if applicable); violation of the “Prompt Payment Act” (if applicable); violation of the Trust Fund Statute (if applicable); and a demand for money damages in the principal amount owed, interest on that amount, cost of court, attorneys’ fees, and statutory penalties (if applicable).
