Texas Payment Bond Claim Laws

What Laws Control the Public Payment Bond Claim Process?

Texas Government Code Chapter 2253 sets forth the requirements, procedures, and deadlines for making a Claim against a public Payment Bond.  These statutes are strictly enforced by the courts.  If you fail to timely serve any of the required notices or fail to timely file a Lawsuit to enforce payment under the Payment Bond, then you have likely waived your right to enforce payment by way of the Payment Bond Claim Process.
